These Terms & Conditions (“Terms”) govern your participation in the rewards campaign (the “Campaign”) operated through [Your App Name] (the “Mini App”), which is available within the Opera MiniPay platform on iOS and Android. By participating in the Campaign, you agree to these Terms. Please read them carefully.
1. Eligibility
•
The Campaign is open to users who access the Mini App via Opera MiniPay and who are able to lawfully participate under the laws of their country of residence.
•
By participating, you confirm that you are not located in, a resident of, or otherwise subject to the jurisdiction of any restricted or sanctioned country.
•
The Campaign is not available to individuals or entities where participation would be prohibited by applicable law.
2. Campaign Description
•
The Campaign rewards eligible participants who acquire and hold tokenized gold (XAUT) on the Celo blockchain through the Mini App.
•
The Campaign has two phases:
1.
Accumulation Period (30 days): From the start of the Campaign, you may acquire XAUT and build up your position.
2.
Holding Period (90 days): Immediately after the Accumulation Period ends, the Holding Period begins. During this 90-day period, you must maintain your position in XAUT.
•
To qualify for Rewards, you must maintain your holdings throughout the Holding Period.
3. Reward Calculation and Distribution
•
Rewards will be calculated as a variable percentage of your eligible XAUT holdings, subject to availability and the discretion of the Campaign operator.
•
Your eligible balance will be determined by the lowest balance of XAUT you maintained in your Mini App wallet during the 90-day Holding Period.
•
If you sell or reduce your XAUT balance during the Holding Period, your potential Reward will be reduced accordingly.
•
Rewards will be distributed automatically to your Mini App wallet on the Celo blockchain at the end of the Holding Period.
•
You are not required to take any action to claim Rewards.
•
The Campaign operator reserves the right to adjust the reward percentage, eligibility, and distribution mechanism at any time.
4. Supported Assets
•
The Mini App currently supports transactions in XAUT, USDT, USDC, and other stablecoins as listed in-app.
•
Only holdings of XAUT will be eligible for Rewards under this Campaign.
5. No Guarantee of Value
•
Rewards are denominated in digital tokens, the value of which can fluctuate.
•
The operator does not guarantee the future value, liquidity, or tradability of Rewards or supported assets.
•
You acknowledge that participation involves risks, including the risk of partial or total loss of value.
6. Data and Privacy
•
All transactions and Rewards distributions occur on the Celo blockchain, which is publicly accessible.
•
The operator does not share your personal data with third parties in connection with this Campaign.
•
You acknowledge that blockchain transactions are transparent and permanently recorded.
7. Disclaimers
•
This Campaign is provided on an “as is” and “as available” basis without any warranties.
•
Participation in the Campaign does not create any fiduciary, advisory, or custodial relationship between you and the operator.
•
The operator is not responsible for technical issues, blockchain network failures, or third-party services (including Opera MiniPay) that may affect participation.
8. Taxation
•
You are solely responsible for determining and fulfilling any tax obligations that may apply to your participation in the Campaign or receipt of Rewards.
•
The operator does not provide tax advice and will not be responsible for reporting or paying taxes on your behalf.
9. Limitation of Liability
•
To the maximum extent permitted by law, the operator shall not be liable for any losses, damages, or claims arising out of or relating to participation in the Campaign.
•
In no event shall the operator’s aggregate liability exceed the actual value of Rewards distributed to you.
10. Modifications and Termination
•
The operator reserves the right to modify, suspend, or terminate the Campaign at any time, including prior to the end of the Holding Period, without liability.
•
Any changes to these Terms will be effective immediately upon posting in the Mini App.
11. Governing Law
•
These Terms shall be governed by and construed in accordance with the laws of Switzerland.
•
Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
